Minutes of Conservation Commission
May 13, 2009

Present were: George Kingston, Chair; Martha Hamilton, Vice Chair; Jody O’Brien, Clerk;
Sheron Williams, Michael Salvon, Colleen Foerster and Mary Swords.

Public Hearing - 228 Mapleshade Avenue, Charles & Shirley Mannheim

Clerk, Jody O’Brien read the legal notice into the record. Mr. Kingston said comments from DEP have been received and file #150-380 has been issued.

Representative Joe Petronino said that he did also received the comments from DEP. He explained that they would like to put an addition on their garage, a deck and an addition on their home to be built in the outer riparian zone of the Pecousic Brook and pave the driveway. He said he delineated the area below the fuzzy cap moss and anything that was sphagnum moss he is calling wetland. Mr. Petronino said proposed addition is 888 feet and Mr. Stinson is saying that the deck really doesn’t apply.

Mr. Kingston said that it looks like a good project and asked how much square footage is being added to the house not counting the deck. Mr. Petronino said 4,975 square feet and they are actually disturbing only about 1,00 square feet over lawn and some of it’s deck. Mr. Kingston said that there are two things that need to happen, one is a revised Notice of Intent that shows that in fat it’s riverfront because it is not shown, secondly was it included on how he did the mean annual high water. Mr. Petronino said yes it is included in his narrative. Mr. Kingston addressed the Commission for any questions.

Ms. O’Brien asked where is the drainage for the proposed asphalt going to go. Mr. Petronino said that it will continue drain just as it always has. Mr. Kingston said that the notice needs to be revised addressing each of DEP’s comments. Mr. Petronino asked the Commissioners if they would like to schedule and on site visit. The Commission scheduled the on site on Tuesday, May 19, 200 at 6:00 p.m. Upon motion duly made and seconded, the Commission vote unanimously (7-0) to continue the hearing to May 27th at 7:15 p.m.




Discussion regarding the new Flood Plain Map

Mr. Kingston said that there a new proposed flood plain map that the Commission has been asked to comment on and he asked Dan Hellyer to attend to tell the Commission about the map. He said that it’s the same as the old flood plain map and we know that we have floods in areas that are not designated.

Building Inspector, Dan Hellyer said that he is the flood plain manager for the town and FEMA is switching to digital FIRMS (Flood Insurance Rate Maps) that actually show the houses. He said that he and Mr. Kingston have discussed the issue with Eric Carlson from the Commonwealth, DCR. He said we had some concerns about the flood plains that they have expanded and they are not properly reflected on the FIRMS because the town’s FIRM was 1978. Mr. Hellyer said all they did was take 1978 FIRM and put it on a digital format and he has completed three courses of FEMA and his next course will be community rating system to see if he can get the town’s rating system up because we don’t have one and it will reduce the percentage of the rate for the homeowner’s that are purchasing it. He said basically he wanted the Commission to take a look at areas that are of concerns. After further discussion Mr. Hellyer said that he can’t determine how many houses are in flood zone and he wants FEMA to come and take a serious look at the maps with him.

Informal meeting with the new Selectmen – Paul Federici

Mr. Kingston introduced Mr. Federici to the Commission and wanted him to meet the Commissioners and explain a little about what the Commission does. He said that the Commission’s job is to administer the Wetlands & River Acts and to enforce them. Mr. Kingston said that the Commission deals with partially every building project in town because and he would say probably 80% of the building projects have to come before the Commission because the only land left is wetland. Mr. Federici said he understands what they are doing and it’s obviously very important. Mr. Kingston one issue that they are going to bring to the Selectmen after Town Meeting are the parcels of land that were donated to the town for conservation use that got recorded as general use and we would like to see them get recorded as conservation land. After further discussion the Commission thanked Mr. Federici for coming in to meet with Commission and wished all the best.

Request for Certificate of Compliance – Ramon’s Way Lot 4, DEP file #150-366

Mr. Kingston said that he went out and looked at the site and monumentation is there and it looks good. Upon motion duly made and seconded, the Commission voted unanimously (7-0) is issue a Certificate of Compliance for Lot 4, Ramon’s Way, DEP file # 150-326.

The Commission issued a new Certificate of Compliance for 15 Halon Terrace, Lot 4, DEP file #150-326 with the correct book and page information.

Keller’s Way consultant

Mr. Kingston said that there are three proposals for consultants to help the Commission on Keller’s Way who are VHB from Springfield, Tighe & Bond from Westfield and Sherman & Frydryk from Palmer. After further discussion and upon motion duly made and seconded, the Commission voted unanimously (7-0) to use Tighe & Bond as the consultants.


There being no further business and upon motion duly made and seconded, the Commission voted unanimously to close the meeting at 8:00 p.m.
