Minutes of Conservation Commission
June 10, 2009
Present were: George Kingston, Chair; Martha Hamilton, Vice Chair; Jody O’Brien, Clerk; Sheron Williams, Michael Salvon. Colleen Foerster and Mary Swords were not present.
Rededication of Industrial Park
Mr. Kingston informed the Commissioners that the industrial park was being rededicated in memory of Joseph Dilk. If anyone is interested, the dedication will be held on June 18th at the corner of Shaker Road and Industrial Drive.
Public Meeting Request for Determination of Applicability – 20 Cooley Avenue
Mr. Kingston opened the public meeting. Clerk, Jody O’Brien read the legal notice into the record.
Mr. Kingston said that an on site visit was done on June 1, 2009 and asked the applicant to explain what he is doing.
Applicant, Jeffrey Bouchard of 20 Cooley Avenue said that there is an intermittent stream that goes through his back yard. He said the backyard slopes from the house to down to the brook so they are looking to level off by the house and build a retaining wall on either side in order to have some space up by the house and make sure that he doesn’t lose anymore yard.
Mr. Kingston said that it falls off pretty rapidly and he is proposing to terrace it and put a siltation fence in at the bottom so that if it does wash out nothing will go into the stream. He said that they are using 3 foot high interlocking blocks to make the retaining walls which won’t require a building permit because they are not high enough to require drainage. He said that it’s a pretty straight forward plan but because it’s within the buffer zone a Request for Determination of Applicability was required to keep it legal.
Mr. Kingston said for the record there was no public in attendance with questions to address any no correspondence were received.
Upon motion duly made and seconded, the Commission voted unanimously (5-0) to close the public meeting. Upon motion duly made and seconded, the Commission voted unanimously (5-0) to issue a negative determination not requiring further filing.
Miscellaneous
Mr. Kingston explained to the Commissioners for future Notices of Intent there are a number of conditions placed on the projects that are suppose to be done before construction is started. He said that Ms. Macdonald asked him to put together a list of the things that need to be received prior to issuing a building permit to make sure people are in compliance and went through the checklist.
Request for Partial Certificates of Compliance - Halon Terrace DEP#150-326 for the following:

32 Halon Terr
34Halon Terr
Upon motion duly made and seconded, the Commission voted unanimously (5-0) to issue Partial Certificates of Compliance for 8, 24, 32 and 34 Halon Terrace.
There being no further business and upon motion duly made and seconded, the Commission voted unanimously to close the meeting at 7:30 p.m.
